The Minnesota Pollution Control Agency (MPCA) remains committed to removing intentionally added Per-and polyfluoroalkyl substances (PFAS) from products sold or distributed for personal, residential, commercial, or industrial use. The MPCA invites the public and manufacturers to provide comments on the reporting and fees rule for products containing PFAS.
The MPCA published the notice in the April 21, 2025, edition of the State Register. The notice is also available on the MPCA's website.
The proposed rules clarify Minnesota Statutes requiring a manufacturer or group of manufacturers to submit information to the MPCA about products containing intentionally added PFAS sold, offered for sale, or distributed in Minnesota and allows the MPCA to establish a reporting fee structure to help administer the new program.
The comment period encourages people to provide questions, comments, and feedback on the proposed rule to the administrative law judge (ALJ) assigned to this rulemaking.
Public hearing
The MPCA intends to adopt rules after a public hearing via Webex at 2 p.m. on May 22, 2025, following the Office of Administrative Hearings (OAH) procedures. The hearing will continue until all parties are heard, or until the ALJ adjourns the hearing (no earlier than 5 p.m.).
